Is Hotspot Parking in Fredericton Fair???

Charles,
I parked in town today using the hotspot app on my phone.  I purchased 45 minutes at 1312 hrs as seen on my phone (attached), meaning I was safe until 1357.
The ticket on my window was a parking violation at 1:53 (attached), meaning it was posted 4 minutes before my expiry.

This has been done in other cities, they will write a ticket a few minutes before or after the expiry time hopping the owner will come out a few minutes late .
The funny thing is that I cam to my car approx 1350 hours, well before the time the ticket was dated.

Something stinks here, I wonder how many others have had this happen to them? More revenue generation on the backs of the poor?

  1. Did you know that if you take a photo of the ticket on your phone and upload it to your HotSpot app that HotSpot will resolve the ticket for you?

  2. definitely take it to court if you have to a judge will throw it out based on the close time and error of time proximity - I doubt it would even be forwarded to the court for processing.

  3. This ticket is not valid in law for many reasons, only one of which is issuing it before any offence was committed. The Fredericton City by-law 2.07 (1) says no person shall permit the vehicle to park continuously "for any period of time longer than the amount of time purchased for that parking space." There is no offence until the toll has expired. The City is using tickets like this to recoup money they are wasting on prosecuting innocent people, suspended cops and buying properties and leases to get rid of nightclubs.

    Try writing to the City parking enforcement officer Madonna Peddle madonna.peddle@fredericton.ca or c/o City Hall and explain it to her. The city and courts are also using the wrong process to commence tickets by laying informations instead of issuing tickets with court dates on them, under section 9 - 16 of the Provincial Offences Procedure Act, which means people can be arrested or jailed for non-payment or not showing up to court for a parking ticket. Check the Provincial Court Act, its regulations and forms to see what information should be on tickets. Sadly judges do not throw such tickets out - they help the city use them to collect a lot of money.

    *GASP* A simple photo uploaded to your app and the problem goes away. WOW, what a concept. But such simplicity escapes you lot, because it goes against what drives your hate.

    2. Took a photo and called the office, nothing but crickets! Guess I will have to wait for the court date. The only way to get action is to embarrass the government, they don't seem to have the capability to fix even one simple ticket, they got caught this time and don't know how to get out of it.

  5. Issuing parking tickets isn't that hard. There is no excuse for this. I guess the mayor needs more money...

  6. Most families have two vehicles, One is signed up for hot spot and not the other Isn't. What do u thing took place. ya got it WRONG VEHICLE and ya WRONG PLATE ENTERED.
