New Brunswick Judges Being Investigated!

Not long ago we heard that NB Court of Queen’s Bench Judge Paulette Garnett was in trouble with the Canadian Judicial Council - see link: http://www.cbc.ca/news/canada/new-brunswick/justice-paulette-garnett-chastised-for-very-late-decisions-1.2807772

She has been a NB Court of Queen’s Bench Judge for 16 years, and for 15 of those years she has repeatedly taken more than the lawful time allowed, under the NB Judicature Act, of 6 months, to deliver her decisions – yet the people responsible did nothing about it.

The NB Chief Justice, Earnest Drapeau, has to give his permission when a judge cannot deliver a decision within the required 6 months, so did he know and just ignore this problem for 15 years?
Obviously yes. The Attorneys General of Canada and NB are also responsible for judges - they also did nothing. Justice Garnett was also chastised for being rude and abusive to self represented parties before her, and was ordered to apologise. Charles, you complained of Clendening doing the same to you - this misconduct and abuse has to stop - we need to start complaining.

The Canadian Judicial Council has admitted that Garnett sometimes takes “years” to deliver her decisions, and this has been her MO for almost the entire time she has been a judge, but they decided not to do anything more than allow Garnett to try harder (see link: https://www.cjc-ccm.gc.ca/english/news_en.asp?selMenu=news_2014_1021_en.asp)

Now, another judge of the Court of Queen’s Bench is being investigated by the Canadian Judicial Council – Judge Bruce Noble of the Family Division of the Court of Queen’s Bench of New Brunswick. He has also taken years to deliver decisions, and makes entirely inept and negligent decisions, as confirmed by the NB Court of Appeal overturning two of his decisions in July 2013 (follow link to: https://www.gnb.ca/cour/03COA1/Decisions/2013/July/july2013-e.asp - see Lambert v. Lacy House and S.H. v. the Minister of Social Development.)

As the attached letter shows, the Canadian Judicial Council has decided to submit a complaint against Bruce Noble, filed in October 2013, to the next level of a Review Panel of up to five judges.
This quite clearly confirms the complaint, filed in October 2013, has merit and substance.
The complaint was for negligence and possible fraud and highlights that Bruce Noble WAS THE CITY OF FREDERICTON SOLICITOR FOR 30 YEARS AND NEVER SPENT ONE DAY IN FAMILY COURT!!!

He has no experience in Family law, which shows in his appalling decisions which are destroying people's lives.

Many of us, who have been involved in family legal issues, have seen first-hand that the NB legal system is set up for failure, because it is not about justice: it is only about lawyers earning a lot of money, with the help of the judges, who are nothing but ex-lawyers.
It is time this changed. We are paying these people – it’s time we got a bang for our bucks - complain and help to change things for the better. Most of the complaints against judges are simply stopped by the NBJC and CJC but we need to wise up and speak out – they are destroying lives.

  1. Someone has to complain about Julian Dickson. He doesn't know what Post Traumatic Stress Disorder or what part of the body a psychiatrist exams. He also tries cases where is friends are victims and he admits bias when he does this. he is one of the rudest judges I have ever seen. During a trial he rolls his eyes, winks at the crown prosecutor, suck in his lips and smacks, reads while the accused is talking, and lies about his decisions. He claims he makes his decisions at the time, but comes out with something heavily highlighted, marked and takes longer to read than the recess was. He has no ethics or ability at all.

  2. I agree with 10:13 - a lot of people need to complain about Dickson. I have seen him behave atrociously and quite opposite to what justice demands. Unfortunately he is like the majority of the judges we have in this province - unethical and a psychopath who has no regard for the law or the people.

  3. Family Courts and Child Protection need to be dealt with severely as they are out of control and do not follow the law period nothing more than a facade,

  4. This is an excellent assessment of judges in the Fredericton area. We did not know what a compassionate, human judge was until Justice William McCarroll came to town. I hope our present judges will take a page out of his book. Learn what PTSD and Mental Health issues are before you send people to jail. Ron Francis was a wonderful man and the RCMP and Fredericton Police Force let him down. How many more will we lose because of their lack of knowledge?

  5. 15:57 I disagree with the lack of knowledge part. I believe in the case of Ron Francis they were fully aware of what they were doing. They certainly know how to trigger a PTSD attack or they were would have arranged to meet him in a safe place for him. On the other hand, they got what they wanted, him dead. This was simply murder.

  6. I also believe they all know what PTSD and the point was to discredit Ron - which Justice Mary Jane Richards helped to be done - she is another rotten judge who has done some bad stuff.

  7. The Dick is the worst judge in N.B.
    He should be investigated. Can you imagine how many people he has sent to rot in jail that didn't

  8. 20:02 - I agree the Dick is a terrible judge but once you experience the other judges they are just a bad, if not even worse. Clendening is a monster and always rules in favour of the government or government agents. She is very clearly biased and prejudiced and the NB court of appeal rules to protect our corrupt judges.

  9. I don't understand what 12:57 means by "all this for an ex cop" - if you mean Ron Francis you should re-read the blog, which you seem to have misunderstood. Or can you explain what you mean? The article is about NB judges being investigated and who had nothing to do with cops, ex or otherwise.

  10. I have recently read a cbc story about judge Bruce Noble taking an early retirement and going to Santa school. Having had his longest decision stayed in the court of appeal and hearing that his decision was not moral ethical or legal a decision that caused earreptable damage to my children. I am releaved to hear he cannot harm children and families anymore. I hope he makes a better Santa than he did a judge.
